Регулирование инвестиций в рамках соглашений ЕАСТ о свободной торговле

Abstract

В статье проведен сравнительный анализ инвестиционных положений соглашений о свободной торговле Европейской ассоциации свободной торговли (ЕАСТ), включая конвенции стран–участниц ЕАСТ, соглашение о Европейской экономической зоне с ЕС, другие соглашения о свободной торговле ЕАСТ с третьими странами. Оценена возможность заключения асимметричного соглашения между Евразийским экономическим союзом (ЕАЭС) и ЕАСТ. Обоснована необходимость включения в соглашение положений, регулирующих взаимные инвестиции ЕАЭС и ЕАСТ для стимулирования глубокой интеграции и включения в глобальные и региональные цепочки создания стоимости. Предложены рекомендации по использованию опыта ЕАСТ в интеграционных процессах ЕАЭС и учету экономических интересов стран ЕАЭС по защите чувствительных отраслей и производств при ведении переговоров со странами ЕАСТ.

The article contains a comparative analysis of the investment provisions in free trade agreements signed by the European Free Trade Association (EFTA), including the EFTA Convention member states, the Agreement on the European economic area with the EU, and other EFTA free trade agreements with third countries. Feasibility of asymmetrical agreement between the Eurasian Economic Union (EAEU) and EFTA has been assessed. Substantiated is the necessity of inserting the regulatory provisions on mutual investment in the agreement between EAEU and EFTA to stimulate deep integration and involvement in the global and regional value chains. Recommendations on applying the EFTA experience in the further integration of the EAEU countries and taking into account the EAEC countries’ economic interests to protect sensitive industries and manufactures’ activities in the process of negotiations with the EFTA countries.
